We incorporate a non-profit organization either under Québec provincial law or under the Canada Not-for-profit Corporations Act. This includes preparing and filing articles of incorporation, bylaws, and registering with the appropriate authority (REQ or Corporations Canada).
- Québec (Provincial NPO): Recognized as a non-profit under Québec law. It benefits from tax exemptions for non-profit activities, but cannot issue donation receipts. The organization must file an annual information return with Revenu Québec
- Federal (NPO with potential charity status): Incorporating federally gives you the option to later apply to the CRA for registration as a charity (public foundation, private foundation, or charitable organization). This allows the entity to issue official donation receipts and for donors to claim tax credits.
- Important: Applying for charitable status is not included in the base incorporation service. It involves additional professional fees and requires a separate consultation with a lawyer, as it is a more complex legal and tax process.
